Terms of Service
These terms govern your use of ellerhurstandco.com and every order placed through it. The store is operated by Corvex Commerce LLC, 30 N Gould St STE R, Sheridan, WY 82801, United States. By placing an order you accept these terms.
1. Who you are contracting with
The seller is Corvex Commerce LLC, trading as Ellerhurst & Co.. Our contact details are at the end of this page and are the same on every page of this store.
2. Products and descriptions
We describe each item from the photographs shown on its product page: cut, neckline, sleeve, visible length, pattern, fastening and the colors it comes in. Screens render color differently, so a shade can read slightly warmer or cooler than on your display. We do not state fibre content, care instructions or measurements, because we do not have verified figures for them, and we would rather leave a field empty than fill it with a guess.
3. Prices and currency
All prices are in USD and are the price you pay for the item. Shipping is calculated separately and shown at checkout before payment. Prices can change, but never for an order that has already been confirmed.
4. How an order is formed
Putting items in the cart is not an order. Your order is placed when you complete checkout, and the order confirmation email confirms that we received it. We may decline an order, for example if an item turns out to be unavailable or if the billing details cannot be verified. If we decline, you are not charged, or you are refunded in full.
5. Payment
The payment methods available to you are shown at checkout and on our Payment Policy page. Payment is captured when the order is placed. We do not store your full card details.
6. Delivery
Delivery terms, costs, cut-off and timings are set out in the Shipping Policy, which forms part of these terms. Risk in the goods passes to you on delivery.
7. Returns
Your return rights are set out in the Return & Refund Policy, which forms part of these terms.
8. Warranties and liability
Except as stated in this section, the products are supplied as described on their product pages, and we do not give further warranties. This exclusion does not touch anything we have promised you elsewhere in these policies: our obligation to deliver what you ordered, to accept returns within the stated window, to cover return shipping on faulty or wrong items, and to refund you as set out in the Return & Refund Policy all remain in force. Nothing here limits liability that cannot be limited under applicable law, including liability for fraud, or for death or personal injury caused by negligence.
9. Acceptable use
Do not use this store to place fraudulent orders, to scrape or copy the site, or to interfere with how it runs. We may refuse service where we see this happening.
10. Intellectual property
The name Ellerhurst & Co., the store design and the text on this site belong to Corvex Commerce LLC and may not be reused without permission.
11. Changes to these terms
We may update these terms. The version published when you place your order is the version that applies to that order.
12. Governing law
These terms are governed by the laws of the State of Wyoming and of the United States. Disputes fall to the courts with jurisdiction over Sheridan County, Wyoming.
13. If part of these terms does not hold
If a provision of these terms turns out to be unenforceable, the rest stays in force.
14. Who can order
You need to be at least 18 years old, or the age of majority in the state you live in, to place an order in this store. By ordering you confirm that you are, and that the payment method you use is yours to use.
15. How we communicate with you about an order
Everything to do with an order runs by email to the address you entered at checkout: the order confirmation, the shipping confirmation with the tracking link, and any refund confirmation. Please make sure the address is correct and that our mail is not filtered away, because that is the channel we use. You can reach us the other way at support@ellerhurstandco.com and by phone during our support hours.
16. Errors in prices and product information
We take care with prices and product pages, but a listing can still carry an obvious error, for example a price that is clearly wrong by an order of magnitude. If that happens on an order you have placed, we contact you before shipping, tell you what the correct information is, and give you the choice between confirming the order at the correct price or cancelling it with a full refund. We do not quietly ship something different from what the page described.
17. Services we rely on
This store runs on Shopify, and payment is handled by the payment providers shown at checkout. Your order data is processed by those services to the extent needed to take payment and deliver your parcel. What is collected and how it is handled is set out in the Privacy Policy.
18. If you break these terms
We may refuse or cancel an order, and refuse further orders, where these terms are broken, in particular where payment details are used fraudulently. Where an order is cancelled for that reason and it has already been paid, it is refunded.
19. The whole agreement
These terms, together with the Shipping Policy, the Return & Refund Policy, the Payment Policy and the Privacy Policy, are the whole agreement between you and Corvex Commerce LLC for an order placed in this store. They replace anything said beforehand about the same subject.
